Revised Form I-9 to Become Effective April 3, 2009 4/1/2009

The current employment eligibility verification form has been revised by U.S. Citizenship and Immigration Services, and employers are to begin using the new form effective April 3, 2009. USCIS published an interim rule in December 2008, indicating that the form would become effective February 2, 2009. However, directives from the Obama administration for further review of pending federal regulations delayed the effective date to April 3. During this time, comments and suggestions for improvements to the pending revision have been submitted to USCIS. To date, there has been no response or comments from USCIS and it appears that the revised form will become effective as scheduled, without further changes.

Employers must begin using this new form as of April 3 for all new hires and for any updates and reverifications. The new form can be found at www.uscis.gov/i-9. On this page, there are also links to the new Employer Handbook and to a Q&A regarding the revised form and list of acceptable documents.
